My speeding ticket: Tale of complete BS!

Gather around children. Sit back and listen to my tale of whoa and BS so that you might heed my warnings... and learn from my mistakes.

Long ago, on Monday 2/15/10 myself and two other friends left my home in Worcester to head up to VT to go skiing for the day. Between 6:20 and 6:30 I was pulled over by an officer from the MA State Police while I was on Rt 2 west. It was right where Rt 2 drops from two lanes in each direction to one(Out near Orange MA I believe).

Anyhow as I was approaching the point where the lanes merge, a state cruiser traveling in the right lane in front of me turned on its lights and pulled into the breakdown lane, slowing down. I too slowed way down, and pulled off to the break down lane as well. I wasn't sure at first why the Officer had pulled over, but in situations like this I always pull to the side to be safe. Turns out I was getting pulled over.

The officer came to the passenger side window, asked for my license/registration, and then informed me I had been clocked going 66 mph entering "one of the most dangerous sections of road in MA" when the speed limit was 55 mph. He then walked away without saying anything else. I think I only had time to say "ok" to him and he was gone. A few minutes later he returned with my license and registration, handed me a ticket and told me the directions were on the back and walked away. He had his mind made up before he even turned on his lights to pull me over.

Now here is what I have trouble with. This is the BS part. Yes I was going 66 mph. I had set my cruise control to 65, but I am not going to argue that. I was however well within the flow of traffic, and I have two witnesses from my car who can verify that. Most of the other cars on the road around us were going the same speed as me. Also the officer was traveling about the same speed as me since I wasn't passing or gaining on him. In fact I had been passed by quite a few cars that morning on that road and after the event I was passed by quite a few more, none of which were pulled over.

Here is the other part that gets me. Between 6:30 and 7:00 am, we saw 6 more cruisers. It was like they were out on the prowl. The part that really gets me. Where I was pulled over was still a two lane highway. After entering "one of the most dangerous roads in MA" I had another cruiser come up on my tail. At this point I had my cruise control set to 55mp, exactly the speed limit. The officer stayed behind me for some time until we came to a large hill. At that point the officer proceeded to move into the climbing lane (the one for 18 wheelers and slow traffic)and pass me, going at least 65 mph. He did this with no lights, no sirens, no horn, nothing and this is the part of Rt2 that is only divided by the double yellow line.

As far as I am aware, the State Police have to follow the laws they enforce.

Anyhow, I am not one cry conspiracy, or hold a grudge against the police. I have and always have had great respect for Police Officers and what they do. But I do feel like there is some serious BS going on here, and like I got a bit of a bum deal.

I am a 28 years old, working as an engineer. I have been driving since I was 17 and have only had two speeding tickets, and only one on my record now. I know some people have better records than me, but I make a point to be a responsible driver. I am currently buried under college loans and trying to buy a home, so it is important to me to keep my insurance rates down. Currently I pay $135/month for insurance.

Is this worth getting a lawyer for?

Let me know what you guys think... I need a good tactic to fight this one. I know arguing the cop was speeding too won't fly, so I need something better.

What exactly are you going to tell them? "I was breaking the speed limit, but so was everyone else!"
 
Sadly thats the best argument I have at the moment. I'm trying to see if there is something better.
 
No. You were speeding and were caught. Its the cold, hard truth. Man up and accept the consequences.

I'm not trying to be a dick, but this is the way it works.

Also, don't expect cops to follow the law. They don't. Where I live, they speed, never signal and drive like assholes. I assume they do the same where you live. Not much you can do about it.

Even if he was speeding, you were still also speeding. So, you could incur cost to try to get him in trouble if it would make you feel better, but you will still have a ticket in your name.
 
Unfortunately, you were the one to get caught. You are guilty, however. The fact that other people were breaking the law doesn't help you case.

Just man up and pay the fine or go to court and pray (and beg) for leniency. That is, if you can get off work to go to court and whether, financially, the payoff is worth it.
 
Lawyer Up!!!

Another revenue generating event by our nation's finest. I've had many a bulls*** tickets. Even some states allow you to pay with a CC right there and for an extra $25 you can take classes so it doesn't go on your record. Utter cow making bulls***.

How much would a lawyer cost? Really I don't mind paying the ticket, its the insane insurance hike that comes with it im trying to avoid.

Get a lawyer. He can argue that a responsible driver is taught to not make waves. In other words, to blend with the flow of traffic, and that this is what you were doing at the time. It probably won't get the ticket dismissed, but he might be able to get the state attorney to reduce the speed to five over or something like that. I don't remember about MA (been a long time since I lived there) but I am pretty sure that a ticket for less than 10 over the limit has less (or no) effect on your rates. I would verify that first, obviously. If you have a good lawyer he might get the charge changed to something that results in a fine but no points. I have had cops give me a ticket for no seat belt when we both knew damn well I was wearing one instead of writing the speeding ticket that he knew I would appeal and waste a day in court for both of us. I'm surprised he didn't write it for 5 over. Most of them will if you aren't flying or just generally driving like a dick.
 
Lawyers are expensive, then you miss work, pay the ticket since you were breaking the law, follow the speed limit next time and always watch your surroundings for cops. Live and learn man.

Where the hell do you get your guys at? I just have to show upto the attornys office or fax in a few things and pay... thats it. No missing work at all.

Edit: Eh if 50-110 bucks is expensive to keep 2-4 points off your rec and your insurance down then good for you.. i guess. lol Personally I think my insurance would go up more then that in 6 months time frame.

A attorney will cost 50-110 depending on the ticket obviously.... I have gotten one each time just to keep the points off my rec. No points yet, however I still have to pay the ticket each time. To me its worth that additonal cost just to keep it off your rec and they goto court for you. So you dont have to do a thing other then check your mail for the most part.

Most embarrassing part is I have a Valentine 1 detector but he was posted up on a part where the railroad runs underneath and always makes my radar go off so I ignored it.
Decided not to fight it, it sucks...especially cuz Im working om being a trooper and speeding tickes don't look so good...but all in all I was speeding. So I guess Ill suck it up and pay the fine and take a course to remove my point/s.

That sucks. I have recieved a ticket for passign someone on a two lane road... 65 in a 45... like I want to sit and lolly gag in the on coming traffic lane. That was a 200+ ticket... I forget exactly how much it was but even paying 100 bucks for the attorny it only costed me 40-50 bucks more then just paying the ticket. He was able to get it reduced a little and no points! If I recall correctly that was a 4 point ticket.

I know that exact same spot since I live up that way, well at more so than Worcester. You saw so many cops in that section because shift change is at 7am, and there is a state barracks in Athol (where the lane change is on rt 2).

It sucks but rt 2 is a Pipeline for State Police because of the Leominster and Athol Barracks.
 
It sucks, but you were technically breaking the law still. On that point, you can't really argue. Flow of traffic or not, you were speeding.

Don't know what else to tell you. Getting a lawyer might be a smart idea if it might help keep points off your license.
 
that sux...

in regards to the lawyer thing though, no that would not help anything,,,, but rather simply appeal your ticket. then you just show up in court and give a good impression that you are a safe driver, and hopefully your ticket will either be reduced or withdrawn altogether.

not that im aware of... that was awhile ago to so I no longer have that info available.

Edit: DOH, you meant the lane. Yes it was marked for passing but I was speeding which got me a ticket. That officer was just in a crabby mood that day I think.
