I'm the kid thats stuck in 4th gear. Well throughout the week my dad has been outta town but calling mazda offices in california. he got back tonite and told me that they're saying the lil cone air filter i have on my car is still causing the problem, blah blah blah, im thinking this is bs. and then my dad told me that the dealership told him that the air filter added horse power up to about 10-20.... percent! u heard right! they said 10-20% enhancement of horse power. Wow who knew i got the lucky r1 racing cone filter of horse power. that's bs. they called my dad back too saying that i burnt out my clutch! but whatever. i need to know how many people had their shifter fork broken and had mods like an air intake or somethin and still had it covered under warranty. i know a couple of you guys had this problem. i might be taking this crap to court if i have to. i refuse to pay $1800 for this. thanx for your help.

Have you considered just taking the car to a DIFFERENT dealer?
 
as i saw posted elsewhere......no aftermarket part voids your warranty as long as it passes epa inspection and all environmental tests and has the documentation to prove so....hence your dealer legally cannot refuse to honor your warranty as long as any aftermarket work you've done meets these specs
 
Im telling you man, tell your dad to print up that warranty law stuff and take it to the dealer. Its over at www.sema.org. I gave you a link to it in your first post. This shouldn't be causing you this much trouble, its quite simple. Otherwise, call some other dealers in the area, explain the situation and take it to a different dealer.

You have already won. They stated that the cone filter added an extra 10 to 20% in power. All you need to do is print out the dyno sheets that AEM has for the P5 before and after their CAI, and you have already proven their main arguement wrong.
 
i think you're screwed....mazda will try anything to get out of warranty....all you need to do is add one little aftermarket part and they'll b****....You should have replaced the filter before bringing it to the dealership. Sorry, but i'm pretty sure you don't have a case....damn fine print
 
Trust me, you have a case. All you need is to get them to say in writing that it is the 10 to 20% increase in power that caused the tranny failure. Then, print out the dyno charts of the AEM intake that shows that even with a better designed intake tube and a high flow filter, it still doesn't give a 10 to 20% gain in hp. The plain cone filter will increase the power even less.
 
I dunno what's up with my dealers around here. My dad talked to the district service manager today and my dad asked for a letter that stated what's wrong with my car, and the service manager said that if he gave him one, that would be a "document of correspondence" and that it would "red flag" the vehicle. I dunno what the means but my dad pretty much said that it would void my warranty for this case and for later cases. I'm so mad:mad:. Can they do this whole letter thing? It doesn't make sense to me why wont they just give me a stupid letter telling me whats wrong with my car. The dealership is also saying that i abused my car. i've read lately on these boards that a bunch of dealerships are saying that now. they said i burnt out my clutch and my tires are worn so they're just looking at factors that make it look like im driving car hard. my dad's gonna make a couple more calls. I gotta go relax cause im stressin and so mad right now.
 
yah... thats mazdas thing... they look at your car and say that you abused it if its gonna cost them more than 200 bucks under warranty... i went in there with NOTHING wrong except the tranny thing... and someone had dented my side door... and they said that i must drive the car too hard and abuse it to have "this many problems already".. i was like WTF!!!! and i burny my clutch out.. because when i was stuck in the middle of the freeway offramp w/ a broken transmission stuck into third gear, i was revving and letting the clutch out slowly to gain momentum over to the side of the road.. IMO they should have covered the clutch under warranty because it was caused by their cheap ass tranny... but i said **** it and bit the bullet on the clutch... and after a LONG LONG time of arguing.. they "fixed it" under warranty... but its still doing the same thing, AND because they didnt put my axle back on all the way, my gear oil keeps leaking out... so most of the time (except right after i fill it back up) im driving w/ NO GEAR OIL IN MY ****** TRANNY!!! all because mazda sux... then i tried to take it to another dealer to get them to fix it for me and they told me that the service dept at alhambra mazda (where i went first) had to do it because its their fault... so now they are giving me ALOT OF s***... and i cant take it anywhere else... "**** MAZDA SERVICE! **** THEM UP THEIR STOOPID ASSES!" - jay and silent bob strike back quote lol... good movie
