Okay, so I was driving around the other day and out of no where, the black case behind the rear view mirror just fell off. (This case was the housing and second part of the sensor for the windshield wipers, in case people didnt know.) Since the two parts of the sensor came apart, I now dont have working rain-sensing wipers, kind of upset since I actually like mine...

I examined it later when I got back to my dorm and noticed that there were four contact pieces where it looks like the 2 pieces combined (one piece built into the windshield and the compartment that fell). These four contact points looked like it had glue on them, so i figured the glue must have just broke apart and it came apart...

easy fix for the mazda dealership and under warranty right?

wrong.

i call the mazda dealership and tell them the problem and they tell me that it is impossible for that to happen and it's one solid unit and is not glued together in any way... but they would need to see the car just to make sure.

im like alright, they might be thinking of something different... so i drive to the dealership.

turns out they were right and it is supposed to be one solid piece...

after further examination, we (me and the tech) noticed that my windshield tint strip goes 1/4 inch under where the case is supposed to be on the windsheidl, i did not notice this before...

TURNS OUT, we came to the conclusion that the place who tinted my windshield most likely (100% sure) tried prying that piece off not knowing, broke it, and glued it back togehter hoping i wouldnt notice..

well good job cause i didnt until it broke the other day!!

NEEDLESS TO SAY...

this cant be fixed, a whole new, WHOLE NEW, windshield needs to be ordered...

windshield $462 + labor $150+ = you do the math..

I AM FURIOUS!!

I am going to the shop tomorrow to raise hell and demand for them to buy the windshield/labor..

if they refuse..

im wondering if this is a lawsuit that i can win, (for the total amount of install+part)... seeing as I have visual evidence (I'll have pictures), the receipt of this company doing it, and also the support of the mazda service reps/techs..

i want everyone elses input one whether it's a winnable case, cause if not, i wont even bother and ill just end up figuring something out...

PLEASE GIVE ME INPUT!!

(ill have pictures of it tomorrow when its daytime)
 
IMO I think you have a good case against the tint shop.

I think they would rather pay for it now rather than going to court over it.
 
um....can u manually turn on the wipers? If so, $600 wouldn't have been worth the convenience.

Only problem I see is they could say you ok'd the move.
 
thats why im gonna threaten to take em to court if they dont pay...

i mean yeah they tried taking it off to do a clean good job, but dont force it, or ask me what the hell the things for first?! you know.. and AT LEAST tell me it broke right away?!

i mean come on..

yeah i can but only on the 2 speed setting... and i used the sensor wipers whenever it rained, i mean i used it all the time, i loved it.. and i payed extra for the GT package which has it included... i mean.. im not gonna pay the 600 for it, im gonna end up gluing it myself, but id rather have a whole new unit whihc is why im gonna fight it as hard as i can
 
they werent polite about breaking it! haha well i guess trying to hide is semi polite? but yeah i feel you... idk, i just thnk they SHOULD pay for it and hopefully they do too, it not the courts.
 
What I'm saying is if you go in there screaming and getting all pissed off about the problem when you explain the situation to them they probably won't respond to well.
 
yeah i know, they should know the situation right away so ill know whether they are willing to comply or not, if they refuse to, then ill blow a gasket. aka say **** you and walk out and go to the court house.. haha but you know
 
There's a good chance you'll spend more on court costs than what it costs to replaced the glass, unless of course you win and they have to pay the court costs.

here in FL, insurance covers a 100% on windshields w/ no deductable. If yours is the same, throw a rock at it and call it a day.(wink)

That's what I was thinking... but who told you that is how much the windshield is?? When I busted mine, given it's not a GT, I took it to a buddy's shop and he called to ask how much it would be to get a new one and they said ~$250 IIRC. I asked why it was so much and they said because of the wiper sensor, I told them I didn't have it and after I told them 5 more times because they thought I did and just didn't know it they told me it was $100 less without the sensor.

Try talking to someone that's not Mazda, or just get a small rock and crack it. lol, good luck.
 
i do a lot of highway driving and had a rock chip mine and the insurance footed the bill. I had a mobile service come and put a new one in. The bill said 460$ on it. I guess this is installed price ???? im not sure how that works. The trim around the glass is different now than stock. i like it more, the design took away some of the wind noise too. good look
 
my old mz3 gt had gotten a crack in the windshield and i decided it was too expensive to put the rain sensing one back on (at first the wife and i thought that insurance wasn't going to cover it, but later found out it would have). when ihad them put the regular 3 windshield on it SUCKED when it would rain.

as for the legal situation, it would probably be better for the both of you to settle out of court. court costs would make it not worth it, as well as lawyers fees (cuz in this situation you would probably need one).

you could also threaten to write some sort of letter or do some kind of public address to tell ppl what happened which might hurt their business. i don't know what would be the best way to make it public like that but it's just a thought.

i almost got in the same sort of situation a couple weeks back when i had my tint put on, but instead it was the rear window wiper that got messed up. right after the tint place had applied tint to all the windows i went to the car wash to get rid of some of the adhesive that got on the outisde of the car. and when i get the car washed i hinge the wipers up off the glass. well, when i did that to the back window the whole wiper arm loosely flopped downward. went back to the tint place complaining and all it ended up being was the nut that held it together. it was still strange how that had happened right aftter i had the tint done and no other time that i ever lifted it up
 
i was thinking about a tint strip, then I bought a Valentine 1. Im glad I didnt I guess haha.

But anyways sorry about your situation man, hope er'thing works out.
 
ive had 4 windshields replaced in the past on other cars, its NEVER the same! They streak and water sticks, its terrible! Got to wax it or put some rain-x glossy liquid stuff on it to keep it from spotting and sticking.
 
I think I'd begin by asking to talk to the tech who did your tint. And bring a witness. Ask the guy if he pried on the piece that broke, and see if he admits it. Because if he doesn't, it may be hard to prove anything in court. If he admits it, then be cool about it, but ask the shop to cover the repair cost. If he doesn't... good luck. It'll all depend on the attitude of the shop owner at that point.
 
This is the kind of thing you want to take to small claims court. No lawyer needed, much cheaper then regular court. Get a written statement from mazda saying what they believed happened, and explaining that that everythign is supposed to be once piece.

Tell the judge that the tint shop is the only one who worked on it an they never disclosed any damage and you have now lost partial function of your whipers. You shouldnt have to pay for this, the tint people should, they are the ones who ****** it up

its for NJ, but the general idea is the same in most states. I would call a lawyer and ask if its worth their time for that amount, but usually for small claims you dont need it.
