Well my first car was totaled while parked on my driveway 8o

Really annoying when the other driver hits you AND doesn't have insurance AND you are partly at fault.

just so its clear i am 100% not at fault! The cop talked to him and realized he was all hopped up on big mac!
 
That really sucks. I think I would almost rather have my car totaled rather than have the frame straightened and suspension parts replaced or repaired.

No more crap about it being his fault, the police stated it was the other drivers fault, simple as that.

Any accident you get into, never talk to the other person, call the police and they'll do the talking for you.

You wouldn't imagine how many douche bags have gotten in accidents with me and try to talk their way out of it, mainly because they had no insurance, hell with that, I learned my lesson the hard way and the best advice I can give you is, ignore everything the other driver says and just call the cops.

I highly doubt the frame/chassis was bent...as for suspension parts being replaced...why would that be a problem if they identify all the damaged parts and replace them?
I will be there with the adjuster and I know the auto body/mechanic that will be fixing the car...every bit that was damaged will be fixed.

Yeah the guy started with "I know a ton of mechanics and i work at blah blah blah performance motors so we can get you fixed up without going through insurance companies" (2thumbs) yeah right!(rofl2) the dudes car was a piece of total s*** and had blah blah blah performance sticker plastered on his front window...after seeing his car, i highly doubt this performance shop or the mechanics there can do more than sit around talking about their big turbo build coming up on the sweetest 1997 Civic EX anyone has ever seen! oh man its gunna be soooo sweet!(gtfo)

When he saw i wasn't even considering his option he changed his tune to, "C'mon man I have 5 kids and can't afford insurance. If you file a claim they are going to come after ME to pay for the damages."

I looked into my heart and really felt for the guy...maybe I should try to work something out with him...you know give the guy a break...

then i remembered that i am not a rich guy. wifey and i are waiting to have kids because we aren't in the best place financially...i also remembered ALL the s*** i wanted but didn't buy because i had bills to pay (for example...INSURANCE!) So yeah **** him! things are tough all over...

I will be going through my insurance company. I called the police right away, they came and filed a police report. The guy got a ticket for failure to yield and is 100% at fault.
 
good man! I would of done the same thing. Its not your fault that he over taxes his curent pay scale to pay for his insurence.

I have been in those shoes before where it was either pay for car insurence or eat. Did I get into an accident while having no insurence? yep, I got hit but it was a very light wreck couldnt of been more then 1.5k between both cars. Needless to say that motivated me to get a better paying job. lol

Whatever you do man have th body shop replace the door skins on both doors! Some places will try to just pull and bondo that rear door.
 
wish it was that black and white for me. for some reason a person making an unyielded left in front of me was still 50% my fault (later finalized at my 15% liability), and the number that was reached for my car to be totalled ended up being 75% and not 80 (which worked out better in my case)

the best part was arguing with the other person's rep (even though i shouldn't have). i liked how they told me their client said i "could have stopped" and that they "could not prove i wasn't speeding" last i checked (and i did) the law states the same as you said, basically if im occupying a portion of road i have the right of way. i've even heard of guys trying to avoid accidents and get plenty of liability because they tried to "take matters into their own hands" like they shoulda just let physics run their course

It may depend on the state or the company. I generally see 80%, but they also take into account a "proquote" which can sometimes be in regards to additional damages totaling upwards of $2000 of undetermined damage and depreciation for the extent of damages and repairs needed. So I have seen that particular number cause it to go over the 80% threshold.

But man that totally blows if you were found 15% for your loss. The person occuppying a lane and has "full posession" of the lane has the right of way. Thats BS that they even tried to pull you otherwise! But I agree with what creina1221 said tho, when in regards to negligence taking into account the points of impact is a big deal. For the OP the damage is to the side of the door which is clearly the other guy's fault. But in your case with the front end, it "appears by your damages that you were driving straight and the other guy busted a left from the center suicide lane and your passanger side front end clipped him in the passanger side rear 1/4 panel or bumper area. Thats what i see from your picture. That would mean that he was pretty far through the left turn, however he still has to make sure there is enough room to make the turn otherwise he is doing it in an unsafe manner. ONLY way I would have seen you with any fault is if he was trying to pull into the driveway and his back end was sticking out because he was stopped behind another car or cars waiting for them to move and his back end happened to be out in the road. THAT would be the only way I would have seen you with any fault. Otherwise he made the unsafe turn and obstructed traffic.

Should have had me as your adjuster ;) I would have easily seen your loss as you say at 100% adverse to the other party, even if the other carrier thought otherwise, it would have gone to subrogation, then arbitration and it would have won hands down. Those pesky claimant carriers tried to get you to admit to something on your statement which is lame. I hate when they do it. I've called out so many people on statements tho... its part of our job to fish out the lies.

But in the state of california you can collect from the other carrier any % that you are found to be not at fault "pure comparative neglagence". I just looked up Delaware where you are at and you have to be 50% or less at fault to be able to collect. Either way with all insurance companies if you are less than 51% at fault then its a non-chargeable offense so it wouldn't effect your rates

Yeah I totally missed the post. I was wondering if they pulled it with the tow hook mount in the front.

no the drove it up then anchored it...the tow guy was super careful and took his job very seriously. real nice guy too...gave us all a ride home!
