New 08 Mazda 3 2.0L owner be careful!!

I got my new mazda 3 GS for less than one week. Today I found out the engine has been burning/leaking oil. Took it to my friend's shop to change oil/inspect. It turns out the original oil filter was over torqued and the 2 out of 4 bolts of the oil filter mount was under torqued. My friend in the shop discovered it in a hard way.. we spent 1 hour to clean up the car's underhood and the oil mess on the floor.

Went to dealership, all responsibilities were denied. They said it was probably a mistake from the factory in Japan. well... whatever... they gave me a free oil change for the future.
 
what resposibilty would the dealership have, they didn't build the car!!!

When I picked up the car, the service department told me they did the first oil change. After the accident, they said whatever was on the car was from Japan's factory. (enguard)
 
Don't all dealers do a PDI (pre-delivery inspection) on a new car ?
They may have picked up on the low oil, or oil leak, which is maybe why they did an oil change,
or topped up the oil, without solving/fixing the problem ?
For whatever reason - seems to me, on a brand new unit, the dealer is responsible !
At least they attempted to make it right with a free future oil change,
without admitting fault, since they blamed the factory.
Classic case of passing the buck ? (dunno)
