Hring a lawyer is sort of like hiring a real estate agent to sell your house. Both should know their s*** so they've definitely got you beat there. But how much do they REALLY care? Typically a real estate agent will convince the seller that their house is worth less than it really is... so they can sell it sooner and move on. (they'd rather receive x% of say.. $300k now than wait 6 months for x% of $350k) Lawyers are kind of like that. Even though you think you're paying them well... they always feel they're worth more. They will often take a "reasonable plea" (all the while convincing you that it's the best you'll get) meanwhile... they just want to move on to the next case. If you're competent enough, since it's your money and life, for what you lack in expertise you'll make up for in effort/heart/persistence.

Well it is an agent's fiduciary responsibility to look after the pricing interest of a client but to also be realistic based on the real market which most home owners are completely out of their mind about in today's market. Same goes with a lawyer, you have to get a feel for their motivation yourself though. In any case if it's a huge point violation or bordering on losing your license it makes a lot more sense to get a lawyer (especially w/ certain towns, troopers, etc). In the end if you go yourself and end up losing (it does happen, pleaing with the DA is hit or miss as a civilian) then you'll end up paying a lot more in the end with points, insurance, and a fine usually.

I did the math on my last ticket which was around 75 in a 50 and I decided to just hire a lawyer and ended up only paying $250 for the lawyer (brought cash), he also got me in the court that day even though I wasn't on the list (I forgot to call). and $400 fine, no point careless driving offense. Works for me considering my insurance will explode in NJ with points on it as has happened to me in the past when I decided not to go to court.
 
if your license is on the line, get a lawyer. This is no joke and if you are not familiar with fighting these sort of battles then putting your license on the line to find out is not a good idea.
 
Is it a criminal offense or just a speeding offense? I have gotten reckless driving for driving 101 on 65 and a speeding with aggressive driving for doing 104 on a 65...IDK depends on the cop, both of the tickets were given by state troopers. If its criminal Im telling you right now, get a good lawyer, I mean THE BEST. Period. Its not fun to be next to criminals in orange jumpsuits next to you, oh and dress very nice! If its just a regular speeding ticket dont worry too much, at least thats my experience with tickets here on Florida. Also definitely go get a traffic school diploma before you go to court and show it to them. As for the valentine comment, forget that, or get it as an add-on, when it alerts you the cop already has your speed so your busted anyways, invest in a good laser jammer first, then the valentine as the jammer wont protect you against radar. Good luck man, its not fun indeed.

In hinsight... it probably wasn't the best comparrison. I agree with your point about hiring a lawyer if one's license or significant points are on the line. As for real estate agents... I know full well most buyers have unrealistic expectation on what they feel their homes are worth. I was merely pointing out the fact that most real estate agents will gladly exchange a slightly greater commission in order to expedite a sale. The difference (to them) is usually not significant enough to warrant the extra time/effort it would take to sell a house at a higher pricepoint. To a buyer, on the other hand, that difference can be WELL worth the trouble.

Quick example...

Let's say your house is (realistically) worth $350k Because of the market, it'll take some time (let's say 6 months) to find a suitable buyer. Your agent convinces you the house is worth less and lists it for $325k. It sells in 2 months because of its aggressive pricing.

What did the agent lose? A 6% commisson on $350k is $21k While a 6% on $325k is $19.5k A mere $1,500

What did the seller lose? In this over-simplistic example, they lost $25k

There have been many studies done on this subject. An agent's strategy when selling their own home is vastly different than when they sell someone elses. Can you really blame them though? If the situation was reversed, most of us would probably do the same thing. Agents even have a 'secret code' to communicate with other agents when posting listings. Certain words and phrases imply that the house can be had for less. I believe there's actualy a chapter on this in Freakonomics.

I agree 100%. Having been a judge, an attorney, and a defendant in traffic court, I can tell you that this type of charge can screw up your driving record(and insurance rates) for years to come. You are very smart to get an attorney.

i hate unecessary speeding tickets. Was doin 73 in a 65. Sped up to 85 to get in my left lane (damn turbo not my fault it accelerates so fast :P) so i got clocked at 85 and now i have a 1,000 ticket. SICK! I will fight this. Im not paying a ******* grand for a ******* speeding ticket.....excuse the language.
 
$1000?? how do the CA fines work? $50/mph over? Or is there an initial fine. 1000 dollars seems crazy!

isnt that ****** crazy? 1000 for a god damn speeding ticket. yet on the news i hear celebrities getting DUI's for $500

DUI = $500
Speeding = $1000

ya that makes ****** sense.

i dunno how it works but my county i think is expensive. its this kinda bulls*** that makes me hate our gov't system
 
California is in a bad way finacially. They have been spending like there is no tomorrow but unlike what the federal government is about to do, California can't print money. I read yesterday that California is holding state income tax refunds because they don't have the money to refund, they have already spent the money that did not belong to them. On top of that, they waited til mid January to make this public so it would be too late for you to change your withholdings for the next year. This amounts to a big tax increase for those that are dum enough to let the government hold their money for them til the end of the year.

Here in Ohio....THey can wait that long to process yout ticket....I think they have 8 weeks unless you sign a Waiver to waive your Speedy Trial Process.

I cant beleive this hasn't even been mentioned at all.

I mean 12 months later...GTFO.

As far as dressing for court, my Dad gave me great advice when I went to court on an 83 in a 55 ticket...dress like being there means something to you, but not like a lawyer. I was going to wear a suit, but instead I just went with some nice pants, a dress shirt and a tie. Look like the decent everyman, don't wear super-nice/pretentious clothes.

As for the traffic school thing, you might want to look into that before attending before your trial date. You can't go again for 12 months and often they'll reduce your ticket on the condition that you go to traffic school, so if you've already gone you may look better, but it could also be one less chip you have to play.

One more thing that served me well...get there early. The DA called 5 names 10 minutes before the judge arrived in the courtroom, and I was the only one that was there. I spoke with her one-on-one about my situation and she took time in listening to me and reviewing my driving record. Because of this I was one of the first to see the judge, and I was done in less than 30 minutes. When I left there were 8 people standing around the DA table, all trying to get her to listen to them. Being there early is the way to go.

Well that should be responsible enough to let them hold it but I guess not in this day and age...I feel a little sick to my stomach right now thinking about that actually.
 
i just check with my attorney and i was doing 94 in 55 so i did 39 over which is only 8 points and they wont take my license if i lose with them if you get above 40 you automatically lose license...... 1 point save my license in worst case scenario ...we will see if i can lower points and fine ....
 
What is all this crazyness about losing your license? In ohio I have friends who have gotten pulled over doing ridiculous speeds and they come out of it with 2 points or less. My friend got pulled over doing 79 in a 35 only car on the street. Ended up without any points.

Oh and I know that kind of speed is just stupid.
