Got arrested today.

I dont really think it matters where he hit the rent a cop. I mean in the midst of adrenaline s*** happens.. The guard is lucky he isnt dead. I mean, what jackass would follow someone out to their car? He could be a crazy ****** and shoot him for christs sake,..wtf.. Good job on the defense. I would have done the same thing..or at least just broke his nose or something.bahaha. i hate mall cops, they think they are hard s*** all the time. especially here in MD. these jackass wannabes..jesus christ..w/e..good job.
 
ok, people that have done loss prevention and or some type of security know that once the person leaves the store you can not do anything. Once the person leaves the store all you can do is ask them to return. By law you cant even stop the person from leaving. Your job at this time is to be able to ID the person to the police. The reason they ask you to stay in the store or return to the store is because its easier for them to present you directly to the police. At no time can you use physical force to detain someone. A security guard is nothing more than a citizen officer. Meaning, that they have the same rights as anyone else in the store. It is not their jobs to uphold the law. If a person fears that life is risk or bodily harm then they can do whatever possible to defend their life or the life of others. As for striking the guard with the stick you have to look at it like this. Level of force: Who elevated the level of force? The guard elevated the level of force by removing the stick and trying to use it. In everyway the guard elevated the use of force. He went from verbal, to non voilent, and then to non violent with the use of the stick. Again with the guard being nothing more than a civilian, it would be no different than someone getting a baseball bat out of their car and trying to beat you up with it. You have at all times the right to protect/defend yourself with equal or lesser level of force. Its when you exceed the level of force you or someone else you are trying to protect that it becomes a problem. Levels of force in the police world are defined as verbal, non leathal, and leathal force. Police are still held to the same standard of force protection as everyone else. The only difference is that they have more laws to protect them. But none of those apply to this sutiation as the guard has no more rights than you do at any given time.
 
SUE SUE SUE the security guard. then use the money you won to sue again. sue the mall and the security company that hired the guard. then sue again for the hell of it.

you've resultantly caused yourself more trouble than this whole ordeal was worth.
 
Pepper spray's a b**** aint it...after your first time you quickly learn not to breath anything in. I've been attacked by mall security before. We(me and my friends) ate lunch at the food court. We where a little rowdy, but nothing bad. The on the way out some douchebags threw firecrackers at us(some punk ass kids) and the security guard comes a running with his buddy guard..pepper spray already at hand...he tells us to get against the wall and spread them. I tell the ****** to **** off it was some punk kids blowing s*** up..he restates..I walk towards him telling him to fuckoff and that I didn't do s***. He says he's gonna spray if I come clsoer...so I stop...I start backing up..then get sprayed...and sprayed good I did...In my last little burning lunged/eye movement I spear tackled the one guard. I was arrested..charges where dropped quick when the video was replayed...they where gonna ban me from the mall(where I get groceries for food) until I threatened a lawsuite for the assault issued for no reason. ****, pepper spray hurts when you breath it man.
 
You guy's are not going to beleve this. It get's better. I just receved a phone call from the guards supervisor. It seems these guys made up the story about the shoplifter. They cooked it up so that they would have someone to **** with. And whats more, they have done this before! the first time was with two highschool girls. The accused them of shoplifting and when the cops came and reviewed the tapes they found that they never took anything. It looked like an honest mistake at the time but it is exactly the same scenario. The supervisor noticed this and now they have been fired.

I'm not one for lawsuits and pressing charges. 99% of the time I give them what they deserve. Very few things set me off but I don't like it when people attack me. I don't have anger issues. I have never hurt anyone that wasn't in self defense. In this case I used the baton because it was the only thing available. Normally I carry a Kubaton on my Key chain I just didn't have it on my. Batons are the best non leathal defence wepon. Mace and tazers don't stop everybody. A baton when used correctly can disable an attacker much quicker. Hitting on the back of the neck will not kill you. although if you do not knowe what you are doing you can seriously hurt someone. I would not recomend carrying any kind of defensive baton without traning to properly use it.

One of them grabs me while the other sprays me with peper spray. I've been hit with it before so I knew not to breath any of it. So here I am eyes burning tring to fend off two guards when finally the police show up. It took three oficers to calm me down.They arestedmy for shoplifting,assault ,and resisting arrest. After reviewing the security tapes they found that it was not me in the sam goodie and that the security officer made the first blow I was released a few hours ago.

So what are you going to do with all the money youll be getting?
 
like I said I'm not going to press charges or sue. It wasn't realy that bad on my part. That security gaurd was the only one that got hurt. The other two didn't have a scratch on them.

I would get a good lawyer.. Theyll get the tapes and secure them to make sure you don't get sued by the security guard.

I'm not one to talk to police, but .....maybe I'd press charges against these queers...

think of this, If there was even ONE technicality that made you guilty of just one small crime.... who knows what kind of s*** youd have to go thru....

I'd call a lawyer..... YOU KNOW THEY"D DO IT TO YOU.......
if you had stole something you be sitting with a list of charges....
I would mind seeing these pricks brought up and a few different charges...
including attempted unlawful imprisonment and assault....
it looks like westfield shopping center is responible for what happened to you last night..... the fact that the guys boss said that they knew you didnt steal anything and that they've done this before proves neglience....

not saying what you should do, cuz I dont even know what I'd do....

They don't have any legal grounds to sue. Technicly what they did is a felony If I wanted to I could press charges but I won't.

I don't see it as the mall's fault they didn't even know this had happend before until it happened to me.

One thing I forgot to mention earlier is the gaurd that aproched me was in plain cloths. I didn't realize he was a guard until I saw the other two come running out.
