Got arrested today.

Good thing it wasn't LaFours...or they'd be mopping you up off the pavement. I hear he's even got two kills.

from what i read the security guard swung first. if that is true then i blame nothing on the guy. hell dumb guard like that overstepping his bounds should get the piss beat out of him. if mall security comes up to me for something i didnt do, then for sure as hell they arent gonna grab me, and then if they swing a batton they would be lucky i didnt beat them to death.
 
hm, if the details about the fights are truly what happened, then slayer4u acted correctly, no excess... (imho well done! bad luck you didnt crush the other two apes, maybe next time ^^).. sueing them might be a nice chance to get some additional money...
 
Wow dude..... did this happen at the capitol mall ? I know you in Oly, tho I dont know of any sam goody round here..... all i can say is "wow" .....My neighbor is a security guard, I just reamed on his ol ass yesterday for yelling at my gf's brother for reving his rx-7 before he turned it off in the driveway.....
....I almost killed the "parking lot attendant" at diamond parking lot downtown (at the well) last summer.... for threatening myself, my gf and my 2 month old baby.... and I almost beat the s*** out of every employee of circuit city not too long ago for accusing me of stealing, and I would have too, if any of them had the nuts to follow me out the store.....
what the **** is this world coming to ?

Oh come on man, if ANY dude put his hands on me or whipped out a baton at me without any reason I would LOSE IT in the same way. At that point it's self defense and anything goes in my book. He deserved anything he gets for jumping the gun on him like that.

Deadly force WTF? Hell no. If you know what you're doing it is a means of nocking them out.

I know the laws. I was asaulted not the other way around. The mall has put him on suspention. I found out this morning that these three hae oversterpped mall policy more than once. THat is why the mall put them on suspention. I have a lawyer and he assures me that I cannot be sued for damages.
 
Hmm, interesting read. I'm kinda split on this one too. I don't think a security guard had the right to physically grab you. And, the second he drew a weapon without being provoked, he took the confrontation to a new level, and he deserved to be punished for it.

Where I'm split is the in use of the weapon. Granted I don't know the laws exactly, so bear with me...If a security guard uses a weapon, it's as if a joe-blow citizen did the same thing, no? They have not been deputized and therefore are not allowed to use that force except to defend themselves. (Like armoured car guards in Canada aren't supposed to draw their side-arms to protect the money, only to protect themselves...fine line, I know).

So, the fact that this security guard drew and used a deadly weapon, you should be able to sue for assault, among other things since you were not the person they were looking for in the first place. But, the guard might be able to counter-sue on the grounds of excessive force with a deadly weapon (or some such legal-eze) due to the blow you dealt him. Please, someone corect me if I misunderstand the laws! :)

Either way, the guard was way out of line in the first place, IMO.
 
And just what was the guards intentions????? He had every right to defend himself... You need to sue their asses off.

I have worked in Emergency/Disaster Management, Physical Security for years and we would have tried to assist in bringing charges on the guard ourselves and had them turned into an example for all of other guards to learn from...

There are a few careers where you cannot make a mistake PERIOD!!!! and this is one of them make the mistake and pay dearly!!!!

So do our country a favor and do not let this drop file suits agianst the mall, Sam Goodies, The guard company and then you also have your atty's file Individual suits agianst the owners of each company and them file suits agianst the guard himself freeze all his assets ect... then persue to obtain his entire life via courts!!!

thats what I was thinking...if some dude pulled a baton on you & He WASNT A COP...you all wouldnt do anything?

I dunno if suing would hold up in court, the guard hit him with the baton but, ....I guess a judge would say he should have just gone back into the mall with him......
But then again, if anyone I dont know touched me for violently, I'd start with breaking the hand, wrist, fingers and arm of the person that touched me.....
but then again.... doesnt sound like he stole any cds.....
so maybe that security guard had absolutely NO reason to even be talking to him....

some time someone should start holding these "authority figures" responsible for the s*** they do.... (If I was you slayer4U, I'd have ****** him up too)

If he had stolen anything, ....they'd have throw the ****** book at him....

I love malicious mischief ... that's what they charge people with around here when they didnt do anything wrong, and the cops cant prove that anything ever even happened... "Mal Mis - giving Olympia cops something to do other than putting the evidence up their nose and beating their wifes" on the Oly tip - I got charge with mal mis - charge was dropped .... but I still wasted days and days of my life on that meaningless s***.... had to sit next to tweekers, and wife beaters, and scumbags, every shitbag off the ****** street trying to bum change change and cigs, met some real winners down there... pretty horrible experience....

Everyone should be an "authoritave figure" eveywhere they go in their own community.... fact is nobody has the right to put their hands on anybody else, and if you do, - you can expect what you can expect (an ass whoopin), this is america !

The thing I if he had told me the cops were on thier way I would have waited for them. But instead he desides to try taking me by force. When I was working as a security gaud the one thing they drilled into us was NEVER use force unless you are attact first. It is illegal for them to use any kind of force without provocation. All I did was pull my arm out of his grasp. THis is why we have police. They are the only ones that can legally use force to detain someone. All that guy had to do was tell me the police were on thier way and I would have let the police handle it.
 
I would get on a moral high horse about this but the facts seem pretty simple...

a) slayer4u was violently assaulted by a rent-a-cop (who has no more authority or training than a private citizen) for no reason
b) he kicked the rent-a-cop's ass
c) I think it's funny.

Now if this had been a real officer, I'd sign him up for a Darwin Award.... but this time, good work! If I was packing and someone assaulted me unprovoked with a baton (a potentially lethal weapon) I'd be within my full rights to double-tap him.
