Got arrested today.

I decided to go to the mall to get some new work boots.I couldn't find any I liked so I when't back out to my car. just as I'm unlocking my car door thes security gard walks up and tells me to come with him. I said "why the **** should I" he informs me t
at I was seen by a "Sam Goodie" employee stealing a Cd. I informed him that I was 400yards away at the oposite end of the mall looking at boots. He says "yeah..right now come with me"and he grabs my arm. I pull away from him and he pulls out his batton. He took two swings at me the first hi me in the stomach the second i bloced with my arm. At this point I've lost it(remind yourselves never to push me over the edge) I took his batton and gave one good wack to the back of the neck knocking him clean out. Just as I was reacing for my cell phone to call the cops two more guards com out. This time I aly lost it I ****'n wae right up to them an a ked if they wanted some too. One of them grabs me while the other sprays me with peper spray. I've been hit with it before so I knew not to breath any of it. So here I am eyes burning tring to fend off two guards when finally the police show up. It took three oficers to calm me down.They arestedmy for shoplifting,assault ,and resisting arrest. After reviewing the security tapes they found that it was not me in the sam goodie and that the security officer made the first blow I was released a few hours ago.
 
In Arizona they would have probably charged you for the assault. We have wierd citizen arrest laws (which an arrest by a security guard falls under).

Sucks man. Funny story.
 
you can honestly sue the shizzle out of the mall. I work for Loss prevention in a major retail company and that gaurd was so far out of legality its not even funny. get a lawyer and get paid. if the associate saw you jack the cd, security can grab you as soon as you leave that store. the fact that this jackass approached you outside of the mall by your vehicle with no backup, sounds like some rookie rent-a-cop going to far. rule#1) be iron clad sure that your suspect is guilty. rule#2) never approach alone. seriously, stick it to the man.
 
I just realized it's 3:30 in the blesed AM. So this accually happened yesteray.

My forst job was mallsecurity.(not at this mall) I know how this game is played. I probably shpuld have gone with him but as soon as he pulled that batton it was on.
 
BTW The security guard didn't com to untill I was relesed. I think he learned his lesson.
 
You are lucky you didn't kill him. It wasn't a good idea to hit him in the head with the ASP. That can EASILY kill someone.
 
Damn, i'm just glad to got your chance to get back at those security guards.

I skateboard, so i've had my fair share of security guards. I know in my case, it's usually my fault the harass me, but there's always that image in my head, just knocking out that security guard who tries to take our boards away.

Being "pushed over the edge" is no excuse for what you did. You are lucky they didn't beat you into the ground. Granted they let you go, but you might want to contact your attorney before you get sued for damages by the guard.
 
haggis man he has no problem with that, its on tape that the gaurd struck first, therefore its self defense. besides the gaurd is supposed to be trained to use the baton as a LAST RESORT. but as far as the rest of it. Technically as far as shoplifting, its refered to as a DWA or Detention-without-arrest. They had no grounds to detain you. Unless they clearly ID you on the tape as the guy from Sam goody, theres no excuse, and even then, like i stated in my last post, they waited to long. in order to successfully detain a shoplifter they must have the product still on their persons. Therefore waiting that long you couldve easily handed it off to someone else or ditched it somewhere to go back and get later. I reiterate, they had no grounds. sue the mall first for that part, then feel free to bring a second suit about the guard that attacked you.

just cuz you point out someone on the street and say "hey you look like the guy that broke into my car," does not give PD grounds to arrest. they need that thing, wait, whats it called again, oh yeah evidence.

Too true. The guard was out of line and should be fired, but....

He hit the guard in the back of the neck with the baton. BACK OF THE NECK. That is a use of DEADLY FORCE.

I would not be surprised to see charges, serious charges, filed on the guard's behalf.

NOTE - did you hit him on the neck with the baton, or did you take the baton and hit him with your hand?

I agree. This could have been prevented if you just tossed his baton under a truck and got in your car and left.

Sure you could sue but think about where the money will come from...the paychecks of other security guards who do their job correctly. Raised rents for store owners (sure the GAP and Best Buy can take the heat but the smaller chains cannot).

I would write a formal complaint to the Mall requesting they terminate the security guard's employment. If they don't...then take them to court.

Oh, and BTW, the parking lot is still considered Mall property...which is why it is patrolled by Mall security. The plan is usually to take you back to the office and frisk you there. If you don't have the item, and they cannot make a positive ID they have to let you go. That would have taken 30 minutes, an hour tops. But instead you got hit with pepper spray and arrested by the real cops.
 
I'm split on this since I wasn't there. Of course you want to use the same amount of force being used against you in self defense. But if you feel that your life is seriously threatened and it came down to you or him. Trust me, it'll be him everytime. But if he is just trying to detain you a blow to the back of the neck is probably excessive. Like I said though, I wasn't there so I can't judge.
 
"you lost it"? dude, you need help. you obviously have anger issues, and hitting th gaurd on the neck, and approaching the other gaurds, shows some serious issues. I wouldn't be surprised if they charged you. With what you said i doubt you have a legal leg to stand on to sue them. It might just be a 'rent-a-cop' put it is an authoritave figure in that mall...

but this is America...
 
so chuyler we disagree again. though the parkinglot is mall property there are disgnations for detaining. plus, in order to be in true compliance the suspect needs to be videotaped making the conceal and once that is initiated the suspect then must be followed without obstruction untill said suspect is detained. now seeing as how he wasnt even in the store. i'd say he has grounds to sue.

however, i do agree with the baton-to-the-back-of-the-neck issue. that does seem excessive.
 
security guards job is to watch observer and report what happens. not to detain someone without proper police!
Mall should have police nearby if not there! the mall that i live by has a station there!
legal action on the mall and the guard got what he deserved!
