Engine Fell

seems like this should be warranty from mazda. I would want a new car too and I would tell the lawyer to go F himself.
 
quit drag launching the car. taking it to red line didn't cause the mounts to fail. taking it to red line then dumping the clutch did though. man up and take some of the blame on this one. I know that you weren't driving your grandma to get her weekly meds when this happened.

i don't really drag race the car. i have drag raced it 8 times and thats it i usually do rolls. and twice it happend when i was accelerating from a dead stop. the second time it fell was my fault.

just because you werent abusing the car when the mounts actually failed, doesnt mean that prior abuse wasnt the cause.

every time you dumped the clutch and shock loaded the engine/transmission, it weakened the mount.

then the mount actually failed when you were "accelerating from a dead stop."

This car is so called "wild child" **** mazda, even though I love the car I'm never buying anything that they make again. Mazda reps keep telling me squeaks are normal.

Good if he took it to the track! Broken axles, tranny that's abuse I would somehow understand but our mounts are total s***.

My car has all mounts replaced cuz first I dropped the engine, then my engine kept on hitting the firewall under hard shifts.

(stopwar)i'm with him.....if you buy the cars it's yours, if it's something that fails then it should be fixed. and there's a difference between driving hard and abuse....taking it to the track every day doing hard launches every stop light and redlining every shift is abuse.....having a 'sporty' car and driving like a grandma is something i hate to see. if you got it drive it like you stole it. i have drivin my car hard since day one i don't abuse and nothing has ever gone out on it. after 6 yrs a motor mount is cracked and needs replaced but hey it's been 6 yrs. unless you really baby your car and drive like a granny going to bingo or a bridge game why does everyone call abuse. yeah mazda does like to try and **** people and everyone knows it.....

well the main reason i want a new car is cause i don't know what else could be damaged from all the times the engine fell. but i would like to just take the cash and replace all the mounts and use the rest of the cash for mods to the car but something else is probably wrong with the car that i don't know yet and could take long to come out.
 
What year is your MS3...?
Redlining is not abuse... I hit mine every single day...

considering the owners manual has a very different idea of when to shift I would like to see your statement hold up in a court case. A lot of owners, not just Mazda, would benefit if this were the case.

The owners manual is written for street driving, fuel economy, and not aggressive street driving. Why would the owners manual tell you to drive your vehicle aggressively on public roads? (braindead

Have you ever heard of a rev limiter...? Mazda designed that into the car to prevent damage. Hell, all car manufacturers design it into their cars. You should be able to just floor the car and hit rev limiter all day long without causing damage...car manufacturers design in safety margin!!

I raced my Mazda Miata, hitting the rev limiter all day... I traded the car in with 240K miles...still ran strong...not an engine problem since the day I bought her.

Hitting the rev limiter will not damage a car!!!!
(I am not talking about hitting the rev limiter and dumping a clutch though, I talking about already being in gear and reaching the rev limiter)

its kind of two sided. i drive slow but, if i go out driving at 3am ill open up and drive the hell out of it. to me i think racing is COMPLETELY STUPID. cause the last thing i want to be caught driving on the road with is a couple of dumb asses racing down a 3 lane road. but Mazda should warranty something like that. the s*** they come up with just to void a warranty is ridiculous.

safety margins are built in (like the redline) so that the engine doesn't get damaged under normal circumstances true, but the rev limiter isn't perfect. what happens if you're doing more than recreational driving and you somehow go from 5th to 2nd (when already at high rpms in 5th)....no rev limit in the world is gonna prevent your engine from exceeding it's safety parameters. and either way, redlining this car (stock) doesn't do very good since the power drops off well before it
 
Man this thread is such bulls***. There's no reason the motor mounts should fail so easily on an 08. I could see maybe if the car was 10 years old and this guy was dumping his clutch at every stoplight. Even then, his tranny should break before his motor mounts. You shouldn't have settled for $3500 especially since you will only see $1500 of that. Surely your Mazda has it's warranty still. When your motor mounts broke the dealership should have fixed it no questions asked. Now, I don't know what mods you have, but I'm assuming it's relatively stock.
 
yea ok its a 2008 actually the first time the engine fell i was making a left turn onto a street from a RED LIGHT so i was accelerating slowly and it feel. The second time it feel it was my fault i downshifted with out letting the clutch out softly i the car jumped and the engine fell. The third time, same thing i was making a left turn from a dead stop. And the shifter broke after the second time the engine fell. one of the mechanics said it was probably due to the stress of the engine falling twice. I really like the car and i consider myself to be a pretty decent driver i don't abuse this car like my other friends that have ms3's.

So i called another lawyer and the one i currently have is still going to want to charge me the fees for his work. which i think is gay considering the fact that its not like he did much. he just says "my client is upset and wants a new car"

Real answers to actual questions that people ask instead of the runaround might get you some real help.

I would bet that most people here believe you habitually and continuously abused the hell out of the car. Like ^^ says, 'fess up or quit it.
 
well like most owners i took care of this car during the first 1000 maybe like around 900 miles but after that i really never abused it until 2000 then i would race on streets or at the track but not that often on the track since it takes forever to go up and race. so besides that i usually just race on a roll and i never even go up past 6000rpms like most ms3's stock at least they drop at around 5500 so im trying to understand where they said i hit the rev limiter and also one time i did hit 150 on the freeway so maybe that might be what they are talking about. one of the guys that works at mazda is a friend and he says, the EVO's have a computer that records everything about the driving on the car. he said he doesn't know about mazda but they might have something similar to that. so i'm guessing thats where they are getting their data from. otherwise iono really. and iono what other questions i need to be asked. i try to keep up on this forum more often but don't really have that much time. so thanks for the people trying to help. and the others well thanks for posting (braindead
 
Will..have you even looked up under your car to see if mazda is doing the work? I drove your car and the Shifter feels really stift compared to mine and the Motor rocks harder than a stock one. It feels like theres not even a rear mount installed... I would try to get a new one. BTW, you know you want the Piano Black and white gauge needles
 
The fact they they tried offering a settlement in the first place proves that they understand there is a problem!

what does your retainer agreement state? ask for a copy, the standard rate is 33 1/3% and then it changes to 40% if it goes to trial. he should not be getting that much off of a 3500 settlement. you wont have to pay out of pocket if you go to another attorney, what will happen is the settlement from the new attorney will have his fee taken out. the two attorneys will come to an agreement as to who gets what based on time spent on the case and the work done. But bottom line look at retainer agreement, that is legal binding contract between you and your attorney as to how much they are paid out of your settlement.

Just playing the devils advocate. Yes I know what a rev limiter is and it doesn't mean it will protect an engine from a defect or poor maintenence or what ever else. The owners manual does give tips/instructions on when to shift regardless of wether or not one has read the manual or headed the advice.

The irony is that all cars are built with the ability to break laws and hence could be considered abuse, at the same time being manufactured to accomodate the abuse of careless or performance driving styles.

Large corporations do not stay in business by ceding to to the multitude of customer complaints. It is in their best interest to discourage bogus claims and fix the ones that aren't. As we are not a often a moral society there is no reason to blindly believe claims with out investigating and setting precedent.

yea i do want at least the 2008.5 but iono if they'll do it. if worst comes to worst i'll use the money and 1. either get a new car with it. or 2. take it back and upgrade all the motor mounts. i still haven't decided yet. i'm looking for lawyers but no one replies. it took the one i have right now forever to reply. and supposevly they have photos of something to prove that its been raced and abused. so im kind of worried about that. iono what they are talking about. and the lawyer sounds like a prick.
