Engine Fell

My engine fell 3 times and in addition to that i had the transmission bolt fixed once and my stick shift broke. I've had nothing but bad luck with this car. So i filed for a lemon law case and they said that the car was raced and that they won't give me a new one cause i abused the car. So the attorney said that they are going to give me 3,500 dollars for my inconvenience as a settlement. But the lawyer is getting 2,000 for his part, to me that seems like he was pushing me to take to the money so that he can get his part rather then me getting a new safer car, he wasn't really a friendly lawyer and he didnt communicate that well . i have never gone through something like this so anybody have any advice as to what i should do? i feel this car is unsafe now. and of course being a mazdaspeed3 i want to modify it! heres my question:

Should i trade in my current speed3(which engine's fell 3 times) and use the 3500 as a down payment to a new speed3?

OR

Should I upgrade all the stock mounts with the money (which leaves extra money) and keep the same car.
- my worry with this option is that the car might fall EVEN WITH the upgraded mounts. after taking it to the dealership 3 times to get it fixed it seems to be worthless. is the problem the mounts? does anyone know if upgrading all mounts will end this problem FOR SURE??? are my axles ok after my engine has fallen 3 times? what do i do with this car to ensure that it is SAFE



maybe try for a new lawyer ? i want this done asap. its not fun being in a rental for weeks and visiting the dealership every few weeks because your car has problems. I just want to be safe and enjoy a fast car like evryone should! my friends mazdaspeed3 is LOADED and has no problems WHAT SO EVER. i believe its a manufacture defect but as mazda claims. the car has been red-lined, and so they wont give me a new one.

Real simple if you in fact have used the car in a way that would be deemed not typical and thereby caused all of the problems then you should take the settlement and count your blessings that one is offered.

Replace the mounts as breaking oem mounts isn't really a major issue and upgrades are available. Seems like you need the toughest ones out there, in cabin vibrations be damned.

haha yea that seems like the option im most likely going to choose cause i don't want to keep waiting anymore but i just don't want to be screwed out of the opportunity to get a new car.

Is it the same part that keeps breaking?

Just cause you redlined it is not cause for abuse!! Hell, you could say that on a rainy day your foot slipped off the brake and caused you to redline or some crap like that.

Redlining is not abuse... I hit mine every single day...

how do they know you "raced" the car? and if racing an ms3 makes the mounts fail, which i know is BS, then mazda is in for 1 hell of a lawsuit

I say play the same game they are & push some more....Accept responsibility for nothing & make up whatever s*** possible to place blame elsewhere. Seems to be the acceptable mainstream thing nowadays. Hell, ask for a government bailout for the losses you have incurred by choosing this vehicle.

What did it fall off of...a table? Or did you mean your engine failed?

the MS3 had issues w/ the trans/engine mount failing and the engine actually falling on one side. So his engine FELL not FAILED

No, he meant it literally fell, as in the mount failed and the motor fell.

FYI this is what a motor looks like when the tranny mount fails. Broken mounts will not get you a new car under any states' lemon law. Replace them and be done with it.

Wasnt that the issue with the first batch of 07's the drivers side mount breaking and the engine falling out?

not to be a complete ass, but didn't you post in the 1/4 mile thread asking how to launch? I think that would qualify as racing...and damn, it takes some serious abuse to break a shifter...

For a stock speed 3 around what rpms should i rev the car to. and when i let go off the clutch do i floor the gas or ease it in about half way? my take off's suck horribly and im trying to get better at it.(bow)

If the engine fell due to a failure of the engine mount, that too would be termed a failure...

quit drag launching the car. taking it to red line didn't cause the mounts to fail. taking it to red line then dumping the clutch did though. man up and take some of the blame on this one. I know that you weren't driving your grandma to get her weekly meds when this happened.

most attorneys out here in CA only take 33% of the settlement when they win cases. So if your attorney is taking $2000 out of the $3500 settlement thats 57%!!! No wonder that attorney wants his cash he's making out on that case bro, he should get no more than $1200 for his services dude...

yea ok its a 2008 actually the first time the engine fell i was making a left turn onto a street from a RED LIGHT so i was accelerating slowly and it feel. The second time it feel it was my fault i downshifted with out letting the clutch out softly i the car jumped and the engine fell. The third time, same thing i was making a left turn from a dead stop. And the shifter broke after the second time the engine fell. one of the mechanics said it was probably due to the stress of the engine falling twice. I really like the car and i consider myself to be a pretty decent driver i don't abuse this car like my other friends that have ms3's.

So i called another lawyer and the one i currently have is still going to want to charge me the fees for his work. which i think is gay considering the fact that its not like he did much. he just says "my client is upset and wants a new car"
ok wow i couldn't do that??? ok he might also say that its not safe and stuff like that. but nothing that i would say. thats dumb. at least to me it sounds like it. iono i really want to get another car. but im wondering if i should just use all that money to replace all the other mounts??
