1st speeding ticket, help

you got the ticket lowered from 100 to a 79, i hope you try to fight it and the cop comes in and says you were actually doing 100 and he wins...

How many times can you take the course? From my understanding its once every 18 months right? So to get rid of my 6 points it would take 36 months right? Or does taking it once get rid of 3 points, while waiting out the 18 months gets rid of the other 3?

BTW i got off a speeding ticket 90 in a 45 by FHP. and a careless driving ticket. The other was a 72 in a 40. many other BS tickets, tint, failure to dim headlights, no proof of insurance, etc.
Is there any way I can verify that the points won't go on if I don't cash in the check for ticket over payment? I mean I believe you, but does that work in ny also?

i got caught going 92 in a 55 and recieved a $336 ticket for that likewise. i wasn t flat out speeding either i was trying to pass an ass hole pick-up driver who evoked me to race him as he kept pace with me while i was trying to pass. that was MY ERROR. making the decision to continue accelerating my car way beyond the speed limit just to pass turned out being a waste because i got totally BUSTED!

arn t u worried they re gonna suspend ur license. i am because it will remain on my record for life. and if you drive around sparce parts like i do when cops have nothing to better to do than run ur plate and see that, they ll take the time to pull u over just to say something like... ah well u were grazing the fog line around that corner can i see ur license and registration pls?

i m planning on having a meeting with the sheriff before court and see if we can meditate a script so when were in court in front of the judge he might at least help me keep my license from being suspended and possibly reducing the cost of the fine. i really hope i can gain some points back as well. this is probably wishful thinking but 6 points is going to make my insurance rate sky rocket when the policy renews this spring.

moral of the story is simple. driving on the road is dangerous itself so one must be very cautious and getting caught means u stopped caring for a moment even though u really are an excellent driver.

By mailing in the fine before the court date, you assume the plea of guilty and are not required to show up in court. By doing that (paying and not showing up), you can't plea not-guilty and you cannot lower your points other than letting them ride out over time. I can't remember the exact numbers, but you get one point back every year or something like that.

Oh yeah, and you're the kind of driver that pisses me off, 100 is totally uncalled for in a 55, that is just plain dangerous.

its pretty clear you have never driven in or around new york city I have been in the slow lane between 80 and 90 mph and thats just because I didnt want to get run over maybe in north country people drive the speed limit but here in new york you drive as fast as everyone else does. plain and simple going 55 when traffic is moving 80 is more dangerous than going 80 and flowing with traffic
Well spoken, since many of our highways have just been newly paved. Sometimes in the middle of the night, I have to get out of my lane to let people pass, and I'm doing anything from 80-100. But in my situation, it is my fault, got stuck in gridlock for 30+ min due to road contruction, and a rear end accident. I was late for my presentation, soon as I passed the accident, I had open road, and I dunno I guess I tried to make up for loss time, or just got the urge since the road was clear.

Whoa, the midwest is harsh. In ny you don't lose your license unless its 31+mph over the speed limit, and since it says 79 on the ticket I guess I'm safe. Also though, for those who don't know 55mph is the top speed limit in ny, we don't have 65mph or 70mph speed limits like some states. Oh yea, I don't really consider myself an excellent driver, but I'm also not one of those people who weave through traffic at every chance. I wish you luck with your sheriff meeting.

Everyone seems to think the ol "cop not showing up" crap is a common occurence. The fact is it is not. Cops actually get reprimanded for missing their court dates. If it affects their job and possibly their raises, you can bet they're not gonna miss it 99% of the time. Continuances can also be a source of aggravation for a Judge...they know all the tactics. Go or don't...but don't delay the inevitable. You'll feel better once it's all done.

You can voluntarily take a driver improvement course before your court date. When your case gets called...acknowledge your error and show you've taken corrective measures. Hope the Judge is more sympathetic. It's possible to get some of the points and fines lowered with a sympathetic Judge, but don't expect it.
Do courses count for anything if you take it without the permission of a court? I've heard previous course taken cannot be used for point reduction on recently acquired points. So would that still be the case if I take a course before court? Also, since the ticket doesn't say 31+mph over speed limit, meaning I don't have to go to court. So are you suggesting I fight the ticket and goto court?

The only phone number on the ticket is for the "Traffic Violations Bureau Hearing Offices". Is this the # for the court? Anyway, if you get a ticket deferred, do you still have to send the ticket in with your plead on it? The ticket says it must be answered withing 15 days.
 
The majority here seems to think its best I try to fight this. I'm leaning towards that. But what I'm afraid of is, what if the cop shows up and says to the judge that I was actually going 100, and that he was already lenient for writing 79 on the ticket?
 
what i would suggest is show up for the arraignment. plead no contest. then make a sincere apology followed by a polite request to reduce the demerit of points written on the ticket.

when all is said and done u should just be glad the officer gave u a great deal when he served u that ticket. COME ON! just get along when the getting is good u don t even have to worry about loseing ur driving privilege LIKE ME!

kiss that speeding ticket discount goodbye when ur insurance policey renews

yeah he could do that, i mean you were going over 100, isnt it like anything like 20 over it is considered reckless and they can take your car away or arrested. I wouldnt take this to lightly paying it would probably be best, and take the DD so insurance doesnt go up as much. 100 in 55, oh man thats insane

i dont deserve to get a ticket cuz i know what im doing. FYI Im a college student but i hate cops. 90 in a 45 stupid? You do know your car goes faster then 90 rite? Have you ever been that fast? Or is it too dangerous? Down here in south Florida we have roads that are more open and empty then the I-95. Going 45-55 (the speed limit) is near impossible. Even most of the old ppl dont follow the speed limit. 72 in a 40 wow thats way fast. The cops hid rite after the speed limit drops. 72 man. Once i got outta that car i didnt know if i ever wanted to go that fast again. Talk about a rush. A WHOLE 72 MPH!! my tint was like 5 % over the limit. FAilure to dim my headlights, i got pulled over for supposedly DUI (i left a party) and I was being a prick (cuz thats wat i am) and they couldnt get me for anything else.
The failiure of insurance is the same thing. A different time got pulled over for (reports about a suspicious vehicle) I was in an X5, and was again an asshole. I had my insurance but the fact that i couldnt get it out in 2 1/2 seconds he wrote me a ticket.

YEH I AM AN ASSHOLE. Just look at my aim sn. Do as you plz but dont criticize others for doing what they want. When we are going this fast most ppl that cause accidents are the ones going to slow that decide to move into your lane, or pull out rite in front of you.

The problem with your points are:

Point 1) He knows he is guilty. It's not some BS trumped up charge. He also signed the ticket and was on the receiving end of a "kind" officer who dropped MPH and probably saved this kid some jail time. Do you think a cop is really gonna waste his time writing tickets and defending them in court if his equipment isn't calibrated. This and the "cop won't show" myth are overplayed on this board.

Point 2) Paying the ticket for the reduced MPH is the smart move. The cop always gets the benefit of the doubt in court. How do you think it'll go over if this kid shows up in court to fight it? If the cop gets called out in court, all the he'll need to tell the judge is that he is surprised the ticket is being fought considering he cut the kid a break (which is at the officers discretion just like issuing a warning is.) You'll get the book for certain.

Point 3) Is just plain absurd.

Why even dick around. He knows he did it, he caught a break, pay the ticket and consider how lucky you are. Just be an adult about it.

That's a good one. I would do it myself the next time I get a ticket, except now I can afford to pay all speeding tickets, since I'm waiting on my 30% cut for transferring $37 million from an oil company account in Nigeria.

Also, did you know that you can use old motor oil to fertilize your lawn?
 
Anyway, I've pretty much decided I will fight it, hoping to cut a plea bargain of some sort, and plea guilty to a lesser charge. It is the first moving violations I've ever had. I've had two other parking violations, I paid one, and I won the other.

I'm making this decision since the majority of you say to fight it, and only one person believes that pay it forget it is the best course of action. I'm also making this decision, because I'm under the impressions that the only thing worse that could happen is that I pay a higher fine, in exchange for lower points right?

If anyone else knows otherwise, please let me know.
