Warranty claim denied

So im driving late one night to go grab a bite to eat after a long day at work. was pretty tired at the time and was driving very casually. i notice as i put my car into gears the shifter feels kind of "loose". at a stop light i put it in first, get the car rolling then as i put it into to 2nd i can feel something come loose inside the shift boot and the shifter just completly comes loose. so im stuck in the middle of an intersection trying to get my car into any gear just to move to the side of the road, i eventually limp it into first and am able to get to a parking lot. i then proceded to take the plastic piece off the shifter to see what went wrong, by the looks of it something came loose and the rod with the shift knob on it doesnt want to go back in. the next day i limp the car over to the mazda dealership and was told that they had to overnight parts for it but it would be taken care of. the next day i receive a phone call saying that mazda wants to send over an engineer to inspect my car and make sure it wasn't abused, i said fine as i had no choice in the matter. this morning i receive a phone call saying my warranty claim was denied and that it's going to cost $500 parts and labor, at this point i was getting angry and asked for some answers. i asked how the "engineer" determined the car was abused and the answer i got : we found speeding tickets in your center console. i then asked "well is there any hard evidence, say my driving record through the OBDII or any proof of mis handling the car". i was told that no, nothing of that matter was evident. so basically some speeding tickets that they had to search my car for is whats holding me back from a warranty claim. what can i do about this?
 
That's so much BS I don't know where to begin. What's an engineer doing going through your car? Wasn't he there to look at mechanical aspects not poking around in your glove box? Seems from numerous other posts there is a 'burden of proof' that something you did caused the failure...speeding tickets doesn't seem to meet that concept. And on and on and on...

I'd speak first with the service manager -- if that doesn't resolve the issue, let them know you will be taking this issue up with Mazda directly...heck, throw in the better business bureau too for good measure.

to tell you the truth i believe the speeding tickets are from my previous car, but ill find that out for sure when i pick the car up. i figured this was complete BS
 
Just because you get a ticket doesnt mean your guilty. Thats BS I hate trying to get anything covered under warrenty. Seem like they expect you to kiss their ass cuz they are doing you a favor. I hate service depts!
 
Um, why was the engineer going through your center console... I'd definitely call them on that. Contact Mazda NA immediately to let them know what they tried to pull.
 
If you wind up back in south florida, take the car to gunther mazda in ft. lauderdale. You won't have a problem like that there...
 
and you coulda just been in 6th gear going the speed limit on the highway and just pushed the pedal a bit, you dont need to shift to speed!

For that matter, speeding is not abuse necessarily. Ask them to show you where in the documentation is the authorization to search through your car. Ask them where is the $500 cash that was hidden in the glove box.

does anyone know if they were legally allowed to look through my center console for evidence of abuse towards the shifter/gearbox?
 
I was hoping you were going to say just joking.
There is no way you're paying $500 bucks, they are taking you for a ride.
 
um, no. they should not be riffling through things that have nothing to do with the repair in question...you need to grill them about this.

I'd tell them to give it to you in writing.

please believe i've already started a log with times, dates, and names. im going to ask for everything in writing along with the service managers signature on everything i can get it on
 
WOW - I have heard it all. That is complete and utter BS. There is no reason for them to be going through your center console. They can't use a Speeding Ticket to void anything.

I would demand that in writing. I would talk to the service manager and the GM of the dealership.
 
Have a friend that's a lawyer? If so, just have them make a phone call. No reason to threaten them or anything like that.

I guarantee if you have a lawyer call them, say who they are and that they're representing you, your problems will all go away without anything further needing to be said or done.
 
A thought occurs to me;

Where do dealerships make their money? Not on the showroom but in the service dept. What's the difference in Dealership money between getting something fixed under warrantee where Mazda NA pays, or not-fixed under warrantee and YOU pay? Times being what they are, car dealerships are hurting; sales are down and when people have to choose between taking their car in for regular maintenance or repair and buying food, what do you think their going to choose?

It might be a little easier to see if you can pull one over on an unsuspecting person and make a little extra cash. However, IF this is the case (and I'm not saying it is), they picked the wrong person to screw with. Good work keeping track of all conversations and getting the service manager to sign off on it.
 
I'm anxious to see how this pans out. A friend of mine had transmission troubles in her 08.5. Result was first to rebuild the transmission, then when they realized it was put together wrong, they put a brand new one in.

That is some BS....he had no reason to be rifling through your car. As others have said, call Mazda NA and tell them immediately.

Of course the above bolded quote is not true but could go to show them how they (dealer/tech) can get burned in a he said/she said.
