Some POS Accord Hit My MS3!!!

I was driving down the street on a 4 lane city road when this piece of s*** Accord leaving McDonald's parking lot T-boned me.
Everyone is alright, thank god but my car is not so hot...

the right-front wheel is bent in and wont move...the passenger side is beat to s***...

here comes the best part...the other guy...wait for it...had NO INSURANCE(rant)


I talked to my insurance company and they said they will cover it...possibly waive the deductible because the other guy was at fault...

wifey's and cousin are fine but my neck is toast though...

heading off to see the NE Revolution destroy the LA Galaxy so the day isn't a complete loss!

aw... that ****** sucks. But at least everyone is ok... thats whats important.

Get your neck checked out asap so insurance can pay for the medical bills as well and if they refuse, sue the guy for all he's got.
 
I am a claims adjuster for a car insurance company so this is how it should be going for you

If you have UMPD (uninsured motorist property damage) coverage then you will not have to pay your collision deductible if the guy is uninsured. Or if you have deductible waiver coverage they will waive your deductible if the other guy is uninsured. You're company will verify that he doesn't buy running an MVR, ISO, or SR-1 on him depending on what state you live in.
*ISO is what pulls up the driver's prior claims histry with any type of insurance and checks whether or not they have any insurance or assets to go after if he is uninsured.

So either way you are looking good for not paying your deductible as long as you have one of those coverages on your policy. As for the BI (bodily injury) portion of the claim if you have Medical Payment coverage on the policy it will pay for your checkups and med bills. But if he is uninsured then if you have UMBI (uninsured motorist bodily injury) coverage then they will have a valid umbi exposure and you can make an injury settlement under your car insurance policy/claim to get paid as if it was a settlement with his insurance company (if he had one) and then they will pursue him in subrogation to get back what they have paid out to you so the company gets their money back.

Also judging by your pics and the loss facts, your 100% not at fault for the loss. ANyone pulling from a sidestreet/driveway/parking lot would have to yeild the right of way to a vehicle in posession of the main road. It's a no-brainer I know, I just wanted you to know how insurance handled these things. You're in good luck!

****oh and to total out a vehicle the amoutn of the repair estimate for parts/labor and all of that has to exceed 80% of the ACV (actual cash value) of the vehicle. So if you're car is worth say $20K the damage would have to be at least 16K for it to be totalled.
 
Wow, that's tough to look at.

So not to be off-topic, but, I just recently watched a Chevy pickup truck get pulled onto a flatbed truck with no front wheels at all, at my dad's bodyshop. I started to watch the bumper crunch like hell, and I wondered:

"How the hell would they pull the MS3 up the ramp without totally jackin the front bumper?"

So..how did they pull your car up on that flatbed safely?

wish it was that black and white for me. for some reason a person making an unyielded left in front of me was still 50% my fault (later finalized at my 15% liability), and the number that was reached for my car to be totalled ended up being 75% and not 80 (which worked out better in my case)

the best part was arguing with the other person's rep (even though i shouldn't have). i liked how they told me their client said i "could have stopped" and that they "could not prove i wasn't speeding" last i checked (and i did) the law states the same as you said, basically if im occupying a portion of road i have the right of way. i've even heard of guys trying to avoid accidents and get plenty of liability because they tried to "take matters into their own hands" like they shoulda just let physics run their course

ps...see sig for my crash, ended up being over $13.5k damage

i don't think the chassis was bent at all...if it is then i am going to be real pissed...but again it doesn't look bent...
 
Definitly not a total loss. But that sucks when that happens to a new car. My old 04 RSX Type S was 2 months old when my garage burned down and toasted the whole left side of my car. They didnt even total it. Took 3 months to repair.

Keep in mind here, His insurance company needs to defend him the best they can. If their driver says you were speeding and there's not anything to prove otherwise, they have a duty to defend their driver's statement. Also, there may have been liability assessed on you due to point of impact. If he was making a left turn in front of you, and you struck him in the rear of his vehicle, then I could see there being 10-15% liablity on you, but not 50%. It's a question of who had the greater duty, in this case, he had a duty to yield to the right of way of oncoming traffic, He's majority here.

My dad got his Z06 taken to the dealer to get some warranty work done and SOMEHOW they got the truck low enough for it to not scrape.

By the way, sorry about your car man, that really sucks. Hope you insurance company is cooperative.
 
Well my first car was totaled while parked on my driveway 8o

Really annoying when the other driver hits you AND doesn't have insurance AND you are partly at fault.
