well he made off pretty good .. considering .. broken collar bone , ribs cracked, hip cracked, road rash on both knees and elbows to the bone .. other then that .. hes in a s*** load of pain and heart ache.. it was his first bike .. had it only 1 yr

Yep, there is very little room for error on a bike. It doesn't matter who's fault it is you generally end up hurt.
