MS6 CAI broke......weld pulled away made hole

Hi all my first post here, I just bought a black MS6 from the Mazda dealer in Monrovia California with 14K miles in mint shape. A weird thing happened though, it already had the MazdaSpeed CAI on when it bought it and after around 40 miles I noticed that the arm on the CAI that bolts to the front fender area where the CAI go's through a hole down near the front of the car had pulled away from the CAI main tube and taken about a quarter sized chunk of the CAI with it.

I took it in right away and they said they would cover it under my certified warranty and I'm waiting for the new part to arrive to be installed, has anyone else ever seen this happen?

I will let you all know what happens with the issue.

I spoke with Jason @ Mongomery Mazda in Charlotte, NC. He said that the problem with the intake is not the actual intake itself, but the paperwork for Cali. emissions. It should be good to go in a couple of weeks. It's all a paperwork issue with emissions.
 
OK so now the the story changes, they cant order the mazdaspeed CAI because I live in California and they are having paperwork problems. I mentioned that I have a quarter size hole in the CAI and that it might be important to fix it due to the non filtered air that is getting into the engine. The response from the service rep (the female that works at Mazda Monrovia) was to quit driving the car until they can get a new one in, I asked when this would be and she couldn't say but it might be months.....

Ok so I'm not suppose to drive the car they just sold me for months because they cant get a part (I mentioned its the same one as the AEM but she ignored me) I should keep making the payments for a car that they don't want me to drive but they might get the part in "sooner or later".

I have a thick piece of duct tape wrapped twice over the whole (how ghetto) but I sure as hell cant go without driving the car if I hope to keep the job that allows me to make the payments.

The way it should have been handled

1.Call me and explain that the part the promised 1 week ago cant be purchased just yet but it will happen.

2. Offer to replace it with the stock air box

3. Offer a loaner car

the world is getting more and more like that these days. people just dont give a rats ass anymore...its depressing...
