BAD news guys...I wrecked REALLY bad...

EDIT..sorry if this is in the wrong section, I wasn't thinking, I'm just so shook up right now.

I just got out of the emergency room at the VA hospital. Was on my motorcycle riding in the right hand lane, when some 16 yr old girl in a white toyota tacoma stick shift, didn't look when leaving a parking lot, pulled right out in front of me, and bogged her car. I tried to swerve into the shoulder, but ended up skidding into her truck. I was doing about 45, the speed limit, and couldn't have been going more since I just came from a red about 1 block before. I smacked the back of her truck so hard, that I went over my handlebars, head first into her tailgate, slammed both my legs and knees into her bumper, and fell underneath the car. My bike slid under her car, and slid for a good 50 feet until it hit a curb. It's totally f_cked up. I have some pretty bad bruises and a fracture in my femur. Her tail gate is all dented up from my head.

Oh it gets better....a guy in a Mercedes came up to me and said, "I hate motorcyclists, you deserve to be roadkill." Feels great knowing that I defended this guys' freedom in Iraq. To top it all off, the cops came and cited me. Said I "failed to use due care." What BS, the girl got out of her truck knowing she was wrong. She was crying and it was written all over her face. Apparently, if you hit someone from behind, regardless of circumstances, you're at fault. I might as well take my civic out, and reverse into someone's car, and sue them for a settlement. Vegas traffic laws are full of s***. So now I have a feeling her Daddy is gonna sue me. Great...I have just been robbed of my bike, my health, and soon to be .... even more money when her daddy takes me to court...hope not though...

I hope I have a case, I'm going to see the attorney tomorrow. Keep my fingers crossed...

It might sound cheesy, but I need all the prayers I can get right now.

I always make sure I'm going way faster or slower than everybody in a car. They just don't notice you. I hope youre alright man and I would be lurking around waiting to give that guy in the Mercedes a beat down.

Wow, I am really sorry. As far as the cops citing you. Fight it. My sister was cited in an accident very similiar. (2 cars) Some jackass pulled right out in front of her and she would have Tboned him had she not braked hard. She caught his left back bumper dead on and the cops cited her. We fought it in court and won, traffic laws are never written in stone we learned.

Thanks for the support guys, the guy in the Mercedes is long gone, and there are so many people that have that car in this area, it would be impossible, to find him and give him a piece of my mind.

What REALLY upsets me though and even makes me a little teary eyed, is that I get more help, sympathy, and compassion here on this board, than I did laying in the road mangled.

What a b****. But as you said, you were going the speed limit and she pulled out in front of you. I believe every state has a law that protects victims like you. The general guideline is that if you hit someone from behind it's your fault, however, this does not apply if the person impedes the flow of traffic like this little girl did. Witnesses that can testify to her foolishness will give you a lot of credibility and hold her responsible. Also any investigator should be able to recreate what happened given the skidmarks, if any, dent in the car and how far your bike actually slide. Here is where physics becomes your best friend. Yeah- I had a guy cut me off a couple years back- damn near side swiped me changing lanes- I was so mad, I kicked the quarter panel of his car HARD (caved it in pretty good surprisingly) as I passed him and he STILL didn't notice. Some people should not be on the road at all..

Well said. The laws regarding a rear end accident can be faught and with what sounds like (and I'm only going on your post) you shouldn't have any problems winning. Are you looking to be compensated for the accident or simply have the ticket dropped?

Get a good lawyer, this happened to me. You should of belted that asshole in the face, by the way. Daddy will try to sue you most likely. The only problem is, you'll need a witness to prove she "cut you off" and you werent' exercising due care. This country has a default rule with bikes, that if you hit something, anything, its your fault until proven otherwise..Thats just how it works. Good luck though bud, hope you feel better.

I pray everything works out. I really hate people that just cut out without looking. It's happened to me twice. One time some guy in an impreza tried backing out of a parking lot in reverse without looking and almost side swiped me.. another time i was going 120mph and some car turned onto the road going 20mph.. so i swerved onto the shoulder where a tractor trailer was parked up ahead.. and swerved back into the lane right between the car and the tractor trailer. Scariest thing ever. Definately learned a lesson that night

I was considering getting a bike.. but after hearing about a couple of my friends dropping their bike, and now this, kinda makes me reconsider it. I really hope that everything works out for you, and that you recover quickly healthwise also.
