Voicekoil what exactly is the lemon law issue. Does the car need to have a fault that they can not fix for more than 30 days of diagnostic time in your state?
I have the turbo issue also but am living with it for now.
Did you go to the dealer with mods on the car? You have posted that you had mod problems already with this dealer?
If you put the stock exhaust on and drove around your car will still have an oil consumption problem even if you don't see smoke. That would justify a warranty turbo also.
You may have to revert your car to 100% stock but I am sure a 2 or 3 month shake down would get all the bugs out.
In my state a dealer can not void your warranty. They can only deny a claim you make for a part you screwed with. If you put stuff to stock and try another dealer they may not question the fact that the car may have modded if it is genuinely screwed up.
We are all pissed about the smoke screen from the turbo but everyone jumps on the band wagon screaming recall and **** mazda before their car even starts smoking.
In Ohio, you need to have your car in service for 30 days for it to be classified as a lemon, OR have the same thing attempted to be fixed 3 times and still have the problem continue, OR have something happen, and then take it in and have other issues overlooked that were also damaged, 3 times.
I hit 30 days, and had issues overlooked, and had 2 breeches in my sales contract. (band) This has been the same dealer. There is 1 other Mazdaspeed dealer in my area, but I really dont care for them either (when I was originally looking to buy a speed3 they kept calling me telling me they are not in yet, but we have this car for sale are you interested, and kept trying to sell me crap I didnt want and it just got to the point of pissing me off) so that is why I don't go there, both are atleast 30mins from my house, pending traffic.
Im not trying to cry wolf with my dealer to fix the turbo, right now I am certain that it is faulty, I was letting it go because I figured I wouldnt have the car long enough to care. But now Mazda is trying to give me a minimal cash offer versus lemoning my car, and if I would except any offer then I will claim that everything is in perfect working order and would not be able to pursue any legal action after that. I would continue to have the factory and extended warranty though. Mazda also is claiming that my car is fine (before they checked anything) that is why they dont want to Lemon the car, and just gave me an offer. My Attorney told me to get everything fixed and then figure out what I want to do after that. The more stuff I would repair now the better for me because it proves that my car is not fixed and other problems are occuring.
(beer) So Ive been sittin back on my computer and reading the stupid things they have to say about my car, and writing responses to my attorney on them and how what they are saying has no relevance to anything.
As for the dealer voiding the warranty, I wouldnt think they could either because some of the people there are about as sharp as a rubber spoon.(screwy) But they claimed a Mazda Rep looked at my car that morning, so he too is obviously an idiot, he took pictures of stock parts and honestly just made himself sound like a fool. Which is great for me because I easliy explained everything he had to say, so right now they dont have a leg to stand on, so I will find out mon or tues what my attorney has to say.
Anyone else having this turbo problem?
