Failed KYB Exel/GR shock after only 4K miles?

I had to get a warranty replacement of a KYB shock after only 4,000 miles on it.
Guy at the retailer said they never see KYBs go back.
Is this a fluke or could there be something specific to our '08 M5 suspension that would cause such early failure?
15K to 20K I get, I know the rear sucks, but only 4K? Is there any single component or combination I should be checking for failure,
or did I just get a bad shock? no special driving circumstances, right shock fine (repl. at about the same time)
 
I've got about 25,000 on my KYB's on my '07 and no issues so far. I haven't heard of any going that bad so soon... maybe a fluke, bad one?

yes it was leaking quite a bit, just a mess when I pulled it off.
Once off, when I pushed the shaft down it wouldn't pop up by itself.
Drove like crap too- any turns over bumps would cause the rear to sway on that side.


Is it leaking?
