I have been scewed majorly my my insurance company. ok first of all i was trying miss a deer and ended up in a ditch, not too big of a deal car still ran just smashed up the front pretty good. anyways call the insurance compnay tell them what happend and ask what we can do. guy tells me they will pay $1,700 of it without getting a point on my insurance and i can just pay the rest if there is anymore. so i think ok, well for ome reason without my permission the moron ends up filing the claim THAT DAY and next thing i know the insurance company sends me a check, and i call them and the guy that i talked too went out of town and the new guy im talking to says they can't do that now b/c the guy already filed the claim and either they pay for all of it ($2,500, which will give me AND my parents 3pts on our insurance) or i have to pay for it all out of pocket. AND for somer eason the body shop i took the car to to get a QUOTE starts ordering parts for my car and the insuarnce sends me a check, when i havent even filed the claim!!! sorry just had to vent..anything like this ever happen to anyone else?

How are you being screwed? It sounds like they are trying to settle your claim quickly- you wrecked your car and filed a claim, which is what puts points on your insurance in most states- I'm not aware of any ability to cut a deal for no points- either you file a claim, get your car fixed and take your medicine, or you don't file a claim and pay out of pocket?

how? 3pts on my whole familys insurance b/c i swerved to miss a deer? that my freind is getting screwed haha i know all insurance is a rip off but it still sucks. and when they filed the claim the body shop automatically started charging me for re-stocking haha thats screwed

I'm not trying to be a dink here, but you get points because you wrecked, whether its to avoid a deer, a car, a gnome, or a hot chick- doesn't matter. Those are the rules.

They're paying for your car to be fixed, which is their end of the bargain.

It sucks that you wrecked and I'm sorry, but you aren't getting screwed.

I think they considered you fileing the claim if you called and told them about it.

Savy is right. When I was involved in a couple accidents (collisions in insurance-speak) years ago, they start the tape recorder once you say "I had an accident." Ok maybe it's not that cut and dry, but it was something like that. You couldn't have honestly thought that they were just gonna give you advice on what to do and not put it on your record, did you?

In any case, it's good that you aren't hurt.

Insurance companies don't put points on your driving record, nor would any insurance agency have the right to modify one's record. An agency *can* and *will* view your record and look for any points issued by the government. They also keep their own 'rally sheet' with their own scoring and point violations. However, those are seperate from a government record. If you did get points on your government record, it's because you filed a claim and that was submitted to your department of public safety or driver's license office, who then asses points.

Sadly, I must say you shouldn't have tried to avoid the deer. They rather you hit and kill than save the animal. Sorry, that's how it works.
