I need Worker's Comp help...

BEWARE....Kinda long.

About 3 weeks ago, I got injured on the job. They sent me to the hospital and paid for the bill. Turns out that I bruised my rotator cuff and was swolen underneath the shoulder blade...ouch! I could barely open my car door :( . The manager on duty that day assured me that he would take care of everything, so I put my trust in him to get things correct. I was advised by my doctor to take off work for 2 weeks and I have it in writing. During these 2 weeks, I have been stoping in and out of work to give my HR manager all paper work. She is hardly ever there, but after talking to her on the phone, she told me to put everything in her folder. I made copies of everything and kept the originals....Fast foward to now....Pay period is here and they tell me that I don't have a check and that "Worker's Comp" is suppose to send me one by mail. The HR manager is suppose to give Worker's Comp all my info. I call Worker's Comp and they first tell me that it has been approved for both weeks and that after I answer a few questions, they can send it out. (Within the past 4-5 days, I have been doing A LOT of back and forth calling with WC). The next day, they tell me that I'm only covered for 1 week because they can't understand the first referral from the doctor and they believe that it means "light duty". Now I'm getting a little agitated, but I keep my cool. I give them the number to my doctor so they can talk to him themselves. 2 days later, they call and now they are telling me that I am denied all WC for those 2 weeks (pissed). They also said that my job doesn't have ANY paper work for me and that my doctor gave me permission for light duty. I know that this is all bulls***, but I've never been in this situation and need some info.

Right now, I'm looking for a good personal injury lawyer.

BTW, if any locals know of a good lawyer, let me know.
 
sue the living hell out of them... first of all if your doctor gave you rest, then you are entitled to that rest, and once they approve WC they cant just take it away.

I call BS on the employer
 
Sounds like your company's HR manager is a twit...

Couple of things: First, take this into your own hands. Without getting into detail about the injury, contact the insurance company that is providing the Worker's Comp and send them a copy of the original paperwork that you kept. Also try and get your story straight with your own doctor. In doing this, you've got a fighting chance on getting the claim paid.

Secondly, and most unfortunatly, you have actually lost the ability to sue your employer because of the fact you are covered by the worker's comp policy on their business insurance. Now, depending on how you were injured, you might beable to sue someone else... manufacture of equipment you may have been using, ect, and then that lawsuit would then turn into one against your employer (this is called a third party action over lawsuit).

This is exactly what I thought...I called today and they gave me the run around again. I ended up arguing with this arrogant b*tch and I just hung up on her. I couldn't take it anymore. I'm really pist right now!...

I faxed WC everything I had after they told me my job said "I didn't turn in any papers". Now WC is trying to say I took myself out of work and the doctor did not give me permission. They said that the papers I have, even though signed by the Doctor, is not justifiable...wtf? They can't understand what the doctor meant, and now they are trying to interpret it the way they want and they claim that is what they understand after reading the referral.

Well, I was trying to pull a 26 cubic foot refridgerator from a stock aisle in the back of the store. According to my knowledge, this aisle is suppose to be completey clear of other appliances and debree. This aisle was FULL of appliances, debree, and another dolley just laying in the way. Because of this, I ended up tripping and have the fridge fall on me....This is giving me a headache.

Also, I don't know if this will affect me, but before the injury, I got accepted at a new job. I was just waiting for the date of employement to start, which was almost another month later. I only recently put in my 2 weeks notice, because they finally gave me an exact date AFTER the injury happened. I only have just over a week left at my current job.
