That is definitely a doozy to track down especially it only happens once a day. It sounds metal on metal so I don't think it's bushing related. And since your damper assembly has been replaced, I'm actually stumped.
The stain is called Corona stain and it has nothing to do with oil overfill. My old plugs got more stain than that and I've never ever overfilled my oil.
Good idea but that will leave metal shavings if you tap with the pan on. It also means you'll need to get a larger washer every time. I guess you can get a 10 pack and leave it in the car so you can hand it to the tech.

I think you can argue that this can be similar to the Corvette cracked wheel lawsuit. GM deny responsibility because the cracked wheels were due to design defect and not manufacturing defect. 🙄
I had to order online. Local dealers basically quoted me a F U price. I guess it's a high dollar service so they dont to sell their inventory. Just a theory.
I think if you have gone thru a lemon lawyer (should be no cost to you), it would save you the frustration. Plus they can file legal action to cease asset if not made whole in a timely fashion.
