2016~2023 CX-9 Headlights set to off however turn on after a few seconds?

As you can see with a photo the headlight switches are set to off however the headlights turn on after a few seconds. Is this a defect or am I missing something? Note, this appears to only happen in the daylight. At night the lights do not come on in the off position.

In Canada and other countries, Daytime running lights are mandatory. So even if you turn your headlights off, the DRLs are on while driving.
